Terms & conditions

Website Rental

Whilst we will make every effort to ensure that our WordPress websites are free of errors, we will not accept responsibility for any losses incurred due to the malfunctioning of WordPress, 3rd party plugins or its themes, or any part of the website. We are not liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines. We are not responsible for problems arising from modifications made to your website and/or web app made by you or a 3rd party.

Theme Design Customisation

Customisation of a theme is limited to content, imagery, colour and fonts. And, any website is limited by the themes available blocks, widgets and assets. For advanced design customisation, we will provide a written quotation of works. 

Content Optimised by People

Our content is written by AI. The ideas and initial brief is supplied by you and then we instruct AI engines to write the content. We then use people to optimise. All content must be checked and approved by you, the client. We accept no responsibility for errors once published live.  

Foundation SEO (search engine optimisation)

If you are on one of our websites packages, we include foundation SEO as standard. Foundation SEO includes:

  • Page titles
  • Page Descriptions
  • Image Alt tags

Because SEO is a technical ongoing requirement we are not responsible for search engine rankings or poor SEO performance. For more advanced SEO, performance tracking and reporting please speak with us for a quotation. Our SEO (Technical and Content) experts can help you with boosting search engine rankings. 

Website amendments & updates

Once you have viewed and approved your website, Digital LaunchPad will make the website live for public viewing. If after this time you wish to make any alterations to the website then inclusive of your monthly website package is the ability to request minor amendments and updates to your website*, minor amendments are inclusive of the following:

  • Text e.g. content, colour of text and font style
  • Adding images to an agreed existing photo gallery
  • Testimonials
  • Home Page Slider
  • Standard contact us page which includes a contact form capturing contact details: Full Name, Email Address, Phone Number and a Comments Box. Any advanced contact form capturing requests may be subject to a bespoke form development which will carry a separate fee.

Please note minor amendments do not include changes to graphical design, website layout and additional pages. Alterations to graphical design and website layout will incur an additional fee. A quotation can be provided by us upon request.

If you go over your agreed amount of website pages in your agreement/contract you will need to upgrade your website package to the next tier, please contact us on 01892 711 200 for more information.

Monthly support

Our website packages are inclusive of 1 hour & 2 hour per month support and unlimited monthly support, subject to the package you are on, for a maximum of 6 months only.

Support time can be used for:

  • Website updates and amendments mentioned above, including:
    • Content and image changes
  • WordPress CMS help and advice

Payments

We require fees, set out in the signed agreement signed by you to be paid by Standing order per calendar month. If a payment fails or has not been made we reserve the right to suspend all services hosted by us with immediate effect. Once any outstanding invoices or payments have been paid in full we will resume all services.

Monthly payments 

We reserve the right to temporarily disable your website and hosting if payments are missed. failure to continue making payments and fulfill your contract will result in your website being permanently disabled and all data and services removed.

Contract

The minimum period for your contract is stated in your signed agreement. If you terminate the contractbefore the end of the agreed signed agreement or contract term you will be required to pay the full remaining outstanding balance in full and an additional termination fee will be added to the final invoice.

To reflect supplier costs, Digital LaunchPad may change the fees charged to you for your services at any time. For packages billed on a monthly subscription basis, the change will become active at the end of the then-current monthly billing cycle of your package. Digital LaunchPad will provide you with advance notice of any change in fees.

Hosting

  1. Monthly hosting is included within our WordPress Themed website packages for 12 months only. After 
  2. Single price packages include 12 months hosting. 
  3. After one year, the price for hosting will depend upon the current market rate, bandwith requirements, our services offered and an admin fee.  
  4. Email accounts are not included with any website package 
  5. Email accounts can be purchased separately.

Ownership & rental

A rented website remains the property of us during the agreement or contract period. If you wish to cancel your agreement or contract after the initial twenty four months, we will provide you with a monthly or annual hosting fee.

Our websites’ are WordPress Premium themed templates using many different 3rd party plugins which require ongoing maintenance. 

If you wish to keep all services active after you have canceled your agreement or contract with us, we will provide you a monthly or annual hosting cost to retain your services.

If you have purchased a website from us, we will not include any updates, all updates thereafter are charged at a set fee. Please ask for a quotation. 

Domain name registration

Our website rental packages do not include any Domain Names, if you require a domain name or names you will be required to purchase these at your own cost. Should we purchase any domain name on your behalf, we will invoice you separately. If you manage your own Domain Names, you are responsible for managing all DNS settings to point to our servers.

Alternatively, we can use your allocated monthly support time to login and make this changes for you. Please note: you will need to provide us with written login credentials in order to access your domain service provider account

Email accounts & setup 

Email accounts / addresses are not included within our packages. You must purchase email accounts yourself. 

Browser compatibility

We will make every effort to ensure that any website theme we use will function correctly when viewed in all major internet browsers. However, we cannot guarantee a website will correctly function with all browser software.

  1. We will not support any version of Internet Explorer 

On January 12, 2016 Microsoft announced end of support for: IE10, IE9, and IE8 on Windows 7,Windows 8.1, and Windows 10. Internet Explorer 11 is now the last version of Internet Explorer on these platforms. If you are still using any of these outdated browser platforms, then you are putting your computer system and networks at risk of malware and cyber attacks.

Materials provided by you

We will not accept responsibility for any copyright infringement caused by materials submitted by you. We reserve the right to refuse to use any copyrighted material unless you provide us with proof that you have permission to use such material.

We will not use material provided by you if it includes the following:

  1. Adult themes
  2. Foul or abusive language
  3. Illegal MP3 or other media downloads
  4. Slander or libel
  5. Impersonations
  6. Promotion of violence or terrorism
  7. Racial, sexual, age or political discrimination
  8. Other content we deem inappropriate

The definition of “adult themes” is left entirely to our discretion. 

Annual web hosting

We only offer website hosting for websites we have created.

We will endeavour to maintain a continuous service. However, you accept that server downtime, whether for system upgrades or any other reason, may occur. We will not be liable for any period of downtime or data loss and there will be no compensation paid. We are not responsible for any losses resulting from acts of god or force majeure including civil unrest, riots, floods, drought, fire, war and imposing legislation.

Conditions

By subscribing to an account with us and your continued use of our services means that you agree to be bound by these terms and conditions. These terms and conditions apply to all accounts you have with us. Multiple domains may not be hosted on a single account. Sub domains (where provided) may be used as an extension of the main website. Sub domains may not be used to host additional websites. Any domain names that are forwarded to a website hosted by us or added (using either another provider forwarding service or the Add on or Parked domains feature in the control panel) must belong to the account holder.

Staging server & backups

All our websites are developed on a staging server, where we action changes, updates and maintenance for your (client) approval. Upon ‘client approval’ we push the changes, creating a backup of the live website, to a production environment (live)

You are solely responsible for ensuring you have a copy of your own personal data.

Security

You are responsible for any misuse of your account and you must take steps to ensure that others do not gain unauthorised access to your account. Your password provides access to your account and it is your responsibility to keep your password secure. Sharing your password and account access with unauthorised users is strictly prohibited. You must prevent others from using your account since you will be responsible for the consequences. Attempting to obtain another user’s account password is strictly prohibited and will result in termination of your account. You may not use your account to breach the security of another account. You may not attempt to circumvent user authentication or security of any account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of an account you are not expressly authorised to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools. You may not attempt to interfere with service to any user, host or network or carry out DOS attacks. This includes, but is not limited to; “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a host.

Content

An account provided by us may only be used for lawful purposes. Use of our account to infringe upon any copyright, patent or trademark is prohibited. This includes but is not limited to the offer of sale of any counterfeit merchandise of a trademark holder, unauthorised copying of music, books, photographs, or any other copyrighted work.We reserve the right to suspend or terminate an account immediately in the event of an infringement or suspected infringement (as defined in the preceding paragraph) by you. We also have the right to suspend any account immediately if there is a legal dispute concerning any of the content on your website. If you believe that one of our accounts is being used to infringe a copyright, patent or trademark please email support@digitallaunchpad.co.uk with the appropriate information.

Copywriting Services

You must check all content generated and written by us. If we have written any articles/news/blogs and referenced any sources you must check all references within these articles/news/blogs at all times. We are not liable for any inaccurate content or reference sources used. You must approve and check all content & reference sources before they are placed on your website.

Imagery Services

We include 5x images as standard within our website packages.

For additional images, please contact us for a quotation.

Our imagery services includes the use of AI and library subscription based purchases. You must check all images generated and created by us. We are not liable for any inaccurate imagery or reference sources used. 

You must approve and check all imagery & reference sources before they are placed on your website.

Prohibited content

We do not permit you to use your account to display on a website or otherwise disseminate any of the following content:

  1. Adult material
  2. Foul or abusive language
  3. Illegal MP3 or other media downloads
  4. Slander or libel
  5. Impersonations
  6. Promotion of violence or terrorism
  7. Racial, sexual, age or political discrimination
  8. Archives of image, music or video files or other files for download that may put a serious strain on our hosting facility
  9. Chat rooms
  10. Other content we deem inappropriate

The definition of “adult material” is left entirely to our discretion of and includes but is not limited to all forms of pornography, links to adult sites and advertisements for escort agencies and other adult services. We reserve the right to suspend or terminate any account immediately that is being used to display on a website and/or otherwise disseminate any of the above prohibited content.If you believe that one of our accounts is being used to display on a website and/or otherwise disseminate any of the above prohibited content, please email support@digitallaunchpad.co.uk with the appropriate information.

Business IT Support

We shall provide, or procure the provision of the Services to you as set out in the agreement. We will use reasonable endeavours to provide all services promptly. All dates or times quoted for commencement or completion of any part of the services are estimates only. Services may be provided onsite or remotely via your internet connection or by telephone, at our sole option. Where, in our sole and reasonable opinion, it is necessary and/or desirable for you to install remote support software, such software will be provided by us. We shall be entitled to make variations and additions to the services from time to time, acting reasonably, for operational reasons (provided that these do not materially, adversely affect the Services), to comply with any legal or regulatory obligation or for any other reason.

Without prejudice to us other remedies, we may suspend all or part of the services without prior notice if we reasonably believe the circumstances justify this to protect itself or others, to comply with any law, where you have failed to pay any charges, or if any events occur which would entitle us to terminate this agreement. In making the decision to suspend the services, we are not obliged to consider the cost or damage to you that may be caused by suspension of the services to you. We may also suspend all or part of the Services to carry out maintenance where, in our reasonable opinion, it is necessary or desirable to do so. In such an event, we shall provide you with as much prior notice as is reasonably practicable.

Data protection

The Customer shall act in accordance with the provisions of the Data Protection Act 1998 and all other applicable data protection legislation at all times. You and us acknowledge and agree that the you are the data controller and we are the data processor in respect of all personal data of your personnel (as such terms are defined in the Data Protection Act 1998). You therefore confirms that it is solely responsible for ensuring that any data processing and security obligations that arise from the provision of the Services comply with applicable data protection law. We will only process personal data for the purposes of providing you with the services. We have in place and will maintain for the duration of these terms and conditions appropriate technical and organisational measures against the accidental, unauthorised or unlawful processing, destruction, or disclosure of personal data and adequate security programmes and procedures to ensure that unauthorised persons do not have access to any equipment used to process personal data.

Website contact forms

Website Contact Form Submissions

We are unable to guarantee form submission delivery as there are many variables that can affect whether the email notification can reach an inbox after it is sent out. This is not something specific to Digital LaunchPad but email delivery is an area that many hosting companies are continually trying to help customers to manage. We strongly advise that you test your website contact forms by submitting a test submission to make sure you receive the email test, we would advise that this is tested on a weekly basis. If you do not receive the test email please submit a ticket to support@digitallaunchpad.co.uk

Contact Forms

We provide all websites with one basic theme related contact form containing fields: Name, Phone, Email, Subject, Comment. Should you require a more bespoke form integration to be designed and built we will quote accordingly for these works to be carried out.

Data Backups

Our servers are configured to backup every day. Your data and emails are not guaranteed to be backed up correctly without errors.

It is solely your responsibility to ensure your data is being correctly backed up and securely and stored offsite.

We will not take any responsibility for any failed backups or data loss or corruption.

None contract, pricing & charges

  • Our working hours are between Monday-Friday 9am-16:30pm
  • Our hourly rate is charged at £80+vat
  • Our day rate is charged out at £640+vat
  • Out of hours rate (On Call/Call Out) hourly rate is charged at: £120+vat
  • Payment is due up on invoice
  • You are responsible for the backup up all of your data
  • We will only work on website platforms agreed by us
  • We will not host any website that is not in contract with us

We will not provide or write any legal website policies or requirements for your website including:

  • Terms & Conditions
  • Privacy Policy
  • Terms of Use
  • Cookie Policy
  • Acceptable use

You will need to provide all legal documents.

Web Accessibility Laws & Policies
  • We will not provide or write any policies regarding Web Accessibility.
  • We will not provide any software for testing.
  • We will not carry out any Website Accessibility testing via any 3rd party software.

If you provide us with a Website Accessibility Statement that has been carried out by you or any 3rd party that requires any design or structural element/change to the current website to comply, we will provide you will a written quotation to carry out the necessary changes.

Changes to our terms and conditions

We reserve the right to change our Terms and Conditions. We will post these changes on this page, continued use of your account means you accept the changes we have made.
